Unchecked, it won't be used, the light theme will be used.
Partly checked, it depends on conditions, like what kind of view mode is enabled, maybe it can read what the system is set to and uses that.
Checked, the dark theme will be applied regardless.
One thing it could be is that it is not fully checked. Apart from that, it should just work. For me, it works to switch between dark mode and light mode. When it is set to partly checked, the user interface stays in light mode.

That checkbox is actually tri-state, but your UI isn’t showing the empty/partial/full states correctly. You’re probably missing some style files, so you only see ‘empty’ and ‘full’ instead of the partial state.
